The depressing statistics prompted Russian legislators to tighten the Federal Law. According to the State Statistics Service and the Ministry of Health, Russia is rapidly getting younger, the consumption of alcohol and the number of offenses committed while intoxicated are constantly growing. Deputies of the State Duma of Russia decided to limit the sale of alcohol in Russia in 2019 in a special supplement to the law.

Amendments to the latest version of Federal Law No. 171-FZ, which regulates the circulation of alcohol in Russia, came into force in January 2017. In particular, time limits for the sale of alcoholic beverages have been introduced. It is expected that this measure will have a positive impact on the reduction of crime, the improvement of the nation, and the reduction of alcohol consumption.

What time is it allowed to sell alcohol in Russia?

Paragraph 5 of Article 16 stipulates a period of time for the sale of beer, weak and strong alcohol. In particular, at the all-Russian level, retail outlets are prohibited from selling alcohol-containing drinks from 23 pm to 8 am.

It is allowed to sell alcohol after 23:00:

  1. In public catering establishments with specially equipped rooms for visitors;
  2. In the duty-free zone at airports and border points.

According to the Law, regional authorities are authorized to adjust the time for the sale of alcohol in Russia in a stricter direction. The local authorities of individual regions have gone further and introduced significant restrictions or a complete "alcohol" ban on the red days of the calendar.

Time of sale of alcohol in different regions of Russia in 2019

Many regional governments took advantage of the powers and increased the period of "sobriety". In the Primorsky Territory, the city of Artem, it is forbidden to sell alcohol from 22:00 to 9:00 in the morning. Regions with a valid ban for the period of 22.00-10.00 hours:

  • Belgorod region;
  • The cities of Vyshny Volochek, Essentuki, Izhevsk, Kazan, Kaluga, Pikalevo, Muravlenko, Strezhevoy, Udomlya;
  • Kaliningrad, Kaluga regions;
  • Orenburg, Omsk regions;
  • Republic of Tatarstan, Mordovia;
  • Saratov region;
  • Tver, Tomsk regions;

In the Altai Territory, Ivanovo, Irkutsk, Lipetsk, Vladimir regions, the cities of Tulun, Shuya, alcohol is sold only from nine in the morning until 21.00 in the evening. In the city of Aleksin, on weekends, alcohol is sold only from 14.00 to 22.00.

In the Chechen Republic, alcohol is sold only two hours a day from 8.00 to 10.00 daily, except for Muslim holidays.

In some regions, the authorities took care of sober weekends by limiting or completely banning sales on these days. In the Kirov region, the city of Kirovo-Chepetsk on weekends and holidays, alcohol can be bought from 10.00 to 17.00. The Ulyanovsk authorities generally banned the sale of alcoholic beverages on Saturday and Sunday. Alcohol is not sold on youth day in the Komi Republic.

The ban applies to all retail outlets. Takeaway sales are prohibited in catering establishments.

The time of the ban and the start of the sale of alcohol in Moscow

In December 2014, the Moscow City Duma issued a resolution to stop the sale of alcohol-containing products from 23.00 to 08.00 the next day in all trade enterprises. Cafes and restaurants are not subject to the ban with the condition of no takeaway trade.

Federal Law on Places of Sale of Alcohol

In addition, not only the time of sale of alcohol is important, but also the place of sale. The education of cultural drinking has reached the legislative level throughout the country. The latest amendments clarify the regulation of the sale of alcohol during public and cultural events.

In crowded places, the sale of alcohol stops two hours before the event. The resumption of trade begins no earlier than one hour after the end of public meetings. The restriction applies to the venue of the social and cultural event and the surrounding areas.

Under completely alcohol-free zones fall:

  • Market squares of retail and wholesale trade;
  • Military and strategic facilities;
  • Sports facilities, especially during competitions;
  • Railway, bus stations, airports and other passenger transport enterprises;
  • Production facilities, especially those associated with hazardous production;
  • Venues for public events with at least 100 participants;
  • Territories adjacent to kindergartens, schools and other educational institutions;
  • Hospitals, polyclinics, health resorts, sanatoriums and other medical and recreational institutions.

Local authorities independently regulate the permissible boundaries of places where the sale of alcoholic beverages is restricted. It is expected that schemes with borders and nearest retail outlets will be published on city portals. By the way, the Supreme Court issued a decision clarifying a number of incidents:

  • It is forbidden to sell alcohol in stores located in non-residential levels of high-rise buildings, if the entrance to the outlet is located from the side of the courtyard with a children's playground;
  • in the parks, forest areas and urban gardens intended for tourism, sports. The exception is cafes and restaurants;
  • Catering establishments undertake to equip special premises for visitors with at least six tables for consumption on site.

Responsibility for violating the "alcohol" prohibition

Control over the implementation of the Federal Law on state regulation of the sale of alcoholic beverages is entrusted to supervisory agencies. The Administrative Code provides for the imposition of penalties on trading enterprises and responsible persons.

The Administrative Code does not provide for the application of penalties to citizens who buy alcohol from the wrong time.

Part 3 of Article 14.16 of the Code of the Russian Federation provides for the following types of penalties for the sale of alcohol at night:

  1. CEO of a trading company or trading network- collection of a fine of 5-10 thousand rubles;
  2. Legal entities are subject to penalties in the amount of 50 -100 thousand rubles.

The main document that regulates the rules for the sale of alcohol in the territory Russian Federation, is Federal Law No. 171-FZ of November 22, 1995 “On State Regulation of the Production and Turnover of Ethyl Alcohol, Alcoholic and Alcohol-Containing Products and on Limiting the Consumption (Drinking) of Alcoholic Products”.

Permitted hours for the sale of alcohol

The period of time during which the retail outlets it is allowed to trade in alcoholic products, is established by paragraph 5 of article 16 of the specified regulatory legal act. This section of the legislation determines that it is permissible to carry out the retail sale of alcohol in Russia from 8 a.m. to 11 p.m. Accordingly, in the period from 23 to 8 hours, the sale of alcoholic beverages at retail is prohibited. These requirements are subject to local time in each subject of the Russian Federation.

At the same time, the same section of the law on the procedure for the sale of alcohol emphasizes that these requirements do not apply to all types of organizations engaged in the sale of alcoholic products. Thus, these restrictions do not apply to organizations providing catering services, as well as duty-free shops, known as "-free".

At the same time, public catering organizations can sell any type of alcohol during the opening hours of their institution. If an individual entrepreneur is engaged in the provision of public catering services, during the hours of the ban on the sale of alcohol, that is, from 23 to 8 hours, he has the right to sell only certain types of low-alcohol drinks. In particular, the permitted list, given in the same paragraph 5 of article 16 of the law on the sale of alcohol, includes beer, beer drinks, cider, poiret and mead.

Additional restrictions on the sale of alcohol

When planning, for example, to organize an outlet for the retail sale of alcoholic products, it is necessary to take into account the additional provisions fixed in paragraph 5 of article 16 of the law on the sale of alcohol. In particular, it gives the authorities of the constituent entities of the Russian Federation the right to establish their own restrictions on the retail sale of alcohol that do not contradict federal law. Such restrictions may apply to the time, place and conditions of the sale of alcoholic beverages. At the same time, additional conditions can be arbitrarily stringent, up to a complete ban on the sale of alcohol. Therefore, before taking any steps towards organizing a business in this area, it is necessary to familiarize yourself with local legislation.

Federal legislation (clause 9, article 16 of the Law "On state regulation of the production and circulation of ethyl alcohol ..." dated November 22, 1995 No. 171-FZ) has established since 2012 that the sale of any alcohol is prohibited throughout Russia in the period from 11 pm until 8 am. However, the same law states that local authorities can establish their own, even more stringent, standards - and here everything depends on the position of the regional authorities.

The fantasy of legislators at the level of constituent entities of the Russian Federation (and Moscow, as a city of federal significance, like St. Petersburg and Sevastopol, is not just a city, but a separate entity at the level of a region or a republic) can run wild. For example, in the Belgorod Region it is forbidden to sell alcohol from 10 p.m. to 10 a.m. (Item 1 of Article 2 of the Law of the Belgorod Region dated April 28, 2016 No. 71), in the Moscow Region - from 11 p.m. to 8 a.m. on the basis of federal legislation (previously established by the law of the Moscow Region dated 04/27/2012 No. 40/2012-OZ, the time limit from 21 to 11 was canceled), in Arkhangelsk - from 21 to 10 in the morning, and on some days (September 1, Children's Day, graduation days and youth day) even from 13:00 to 10:00 the next day (paragraph 1 of the Decree of the Government of the Arkhangelsk Region dated 05.06.2012 No. 222-pp).

In other regions, of course, their own restrictions may also be adopted. Therefore, if you are going on a visit to another city, ask in advance what time you can buy alcohol there.

From what time is the ban at night on the sale of alcohol in Moscow

In Moscow itself, a federal norm is still in force - a ban on the sale of alcohol from 23:00 to 08:00 the next day. However, even from these norms there are exceptions - and also at the all-Russian level.

All the same federal law No. 171-FZ directly states that these norms apply only to the retail sale of alcohol and do not apply to restaurants, bars, pubs and other places formally classified as public catering establishments. For them, you need to take into account other rules, according to which sales are allowed after 23:00:

  • strong alcohol - only for legal entities;
  • beer, mead, low-alcohol drinks - to entrepreneurs too.

In addition, the requirements of the law do not apply to duty free shops operating at airports - alcohol is sold there around the clock. However, only air passengers can use these shops.

Where the sale of alcohol in Moscow is absolutely prohibited

In Moscow, as in all of Russia, alcohol is never sold:

  • near children's, medical and sports facilities;
  • in cultural organizations (with the exception of buffets and other food outlets operating under these organizations);
  • at railway stations, airports and other places where there is both a mass gathering of citizens and an increased danger from transport (this does not only apply to the sale of alcoholic beverages in cafes / bars at railway stations and the already mentioned duty-free shops);
  • at military installations and territories adjacent to them;
  • in stalls, tents and other commercial facilities that are not stationary.

In addition, it is prohibited anywhere and at all times to sell any alcoholic beverages to minors. The seller, if he has doubts, has the right to demand a document confirming the identity and age from any buyer. Moreover, even if the minor looks older than his age and the seller will release alcohol to him, it will still be a violation of the law.

The ban on the sale of alcoholic beverages at night is a state-level measure to combat addiction. The time of sale of alcohol in Moscow and other cities of the Russian Federation is regulated by the legislation of the country relevant in the current year. The authors of the laws claim that this measure has a positive impact on the level of crime and the level of alcohol consumption per person. Despite the positive side of the law on the regulation of the production and sale of alcohol-containing products, temporary restrictions on the sale of alcohol in Moscow and other Russian cities vary and bring inconvenience to the population of the country.

Law on the prohibition of the sale of alcoholic beverages

According to the fifth paragraph of Art. 15 of Federal Law, the sale of alcohol-containing products is prohibited at night. The established time frame is nine hours of prohibition from 11 p.m. to 8 a.m. Organs state power has the right to introduce changes to the established law, increasing the time for the sale of alcohol in the capital and other cities of Russia. The problem is to establish a different period of time until how much and how much alcohol is sold in Moscow, the Moscow Region, St. Petersburg and Novorossiysk. The law also specifies places where it is prohibited or permitted to sell liquor during the late evening period. According to the law, the ban on the sale of alcohol in Moscow does not apply to public catering establishments, which are allowed to trade in alcoholic products during the opening hours of a state institution. The law establishes not only the time frame for selling alcohol, but also a list of alcoholic beverages allowed for sale.

Sale time in Moscow

The capital was subject to regular changes in the time of sale of alcohol. In 2010, the sale of alcoholic beverages was allowed from 10 am to 10 pm. In 2011, the time for the sale of alcohol in Moscow decreased by three hours. The time frame for not selling alcohol today is from 23 pm to 8 am for Moscow residents. For residents of the Moscow region, there are stricter limits: sales are allowed from 11 am to 9 pm and, accordingly, are prohibited from 21.00 to 11.00. For the period of 2016, the time frame for selling alcohol in Moscow and the Moscow region is from 08.00 to 23.00.

During the existence and operation of the law, significant changes not in the number of sales of alcoholic beverages, residents of the Russian Federation continue to buy alcohol at the allowed time.

The government of the country empowers the authorities of the regions with the authority to establish a complete ban on the sale of alcoholic beverages of a certain strength, excluding the sale of products that exceed the permitted level. Only wines and beer may remain on the shelves of shops in some regions or cities. These changes took place in the Vladimir region, where the ban lasted about ten days, as the inhabitants of the region became indignant at the established law.

The sale of alcohol at prohibited times is punishable by a fine of 50,000 to 100,000 rubles for the seller and from 5,000 to 10,000 rubles for the manager.
